DeSantis Signals Historic Supreme Court Challenge – Florida’s New Strict Death Penalty Law Contradicts 2008 Ruling

What’s Happening:

Thanks to Florida Gov. Ron DeSantis, we might have a country again. The uncompromising governor has done more for American values than hundreds of “Republicans” in Congress. And numerous red states are following his lead to make bold moves that uphold traditional values and morals.

Here’s something else they’ll need to do to keep up with Ron.

The Republican majority in the state legislature has just proposed a powerful new law. If passed, it will put the fear of God into any criminal that dares hurt young children. But if Ron DeSantis signs this bill into law, he will be going up against the Supreme Court. It doesn’t seem as if he’s scared one bit.

A bill introduced by Florida lawmakers would defy Supreme Court precedent by allowing capital punishment for felons who commit sexual battery on young children if signed into law by Gov. Ron DeSantis (R-FL).

Senate Bill 1342 would directly challenge a 2008 Supreme Court ruling, Kennedy v. Louisiana, which determined the death penalty could not be applied to child rape… If a lawsuit were filed against the bill, it could tee up the matter for eventual review among the nine justices.

Well, if you wanted to outrage liberals more, you’d be out of ideas. Florida could pass a law that requires the death penalty for convicted felons who rape young children. Now, I’m sure you don’t have a problem seeing child rapists get the chair. But Democrats actually oppose the death penalty, one of many things they do to help convicted criminals.

If Gov. DeSantis signs this bill into law, it can lead to a showdown with the Supreme Court. But, let’s be honest here. The ruling this bill might be violating is from 2008 when the court had an even split with a swing vote.

Today, the highest court in the land has a strong, conservative majority. Do you really think they’ll uphold a ruling that protects child rapists? I don’t think so. DeSantis might sign this bill, just for the legal battle.

This could lead to a court case that gives Supreme Court Justice Clarence Thomas a chance to restore the death penalty for various crimes. That’ll be a very good thing, since revoking the death penalty was the left’s first step to the crime epidemic we are seeing today.

Hopefully, other red states start paying attention to DeSantis’s lead. Court battle or not, the more states pass laws like this, the harder it will be for the left will be able to stop them.
