Wade…“The plaintiffs have sincere legal, moral, ideological, and policy objections to elective abortion and to FDA’s relaxed regulation of mifepristone,” he said. “But under Article III of the Constitution, those kinds of objections alone do not establish a justiciable case or controversy in federal court.” The case was remanded back down to the Fifth Circuit consistent with the Court’s opinion.
This will not make many conservatives happy. The Supreme Court shut down a challenge to the FDA’s approval process for the abortion drug mifepristone. While they respected the moral views of those who brought the lawsuit, they claimed they did not have “standing” to prevent a drug from being “less available” to others.
