Texas Plans Major Supreme Court Battle – Governor Vows to Fight for His #1 Historic Case

Texas has been pummeled by the ongoing border crisis that has seen an unprecedented number of illegal immigrants flood across the border under the Biden administration. State leaders have tried multiple ways to stop the influx while Biden’s team has fought them every step of the way.

Texas has won some legal battles against Biden’s failing border policies, yet a new judicial setback has the state’s governor pledging to dig in and fight. Republican Gov. Greg Abbott has proven he is not afraid to take on the federal government and try to stop Biden’s arguably unconstitutional immigration actions.

The federal government may want to consider Texas’ history in challenging governments who cause suffering to the people of the Lone Star state. Abbott has pledged that he plans to fight Biden all the way to the U.S. Supreme Court to gain relief from the border crisis.

According to the Washington Examiner, the standoff between Texas and Biden comes days after the 5th U.S. Circuit Court of Appeals ruled 2-1 to decline the Texas governor’s request to reverse a lower court decision. That ruling upheld the lower court ordering the removal of a 1,000-foot-long string of buoys placed in the Rio Grande river in July. The court ruled the buoys could not be used because the waterway is categorized as a navigable waterway.

Abbott claims that argument doesn’t hold because he says the waterway is “not navigable by definition” and is not used by boats for transportation means. He is preparing for a legal fight up to the highest court.

“We will be seeking what’s called an unbuffed ruling by the entire district court of appeals, and if we lose there, we will take that to the United States Supreme Court because we know Texas has the right to legally deploy those buoys in the water to prevent people from entering our country and our state illegally,” Abbott said on Fox News’s Sunday Morning Futures with Maria Bartiromo.

Abbott even said Texas will keep the buoys in place and is adding to its plans to stop illegal immigration. He confirmed efforts where Texas has already built or is working on more border wall than what the administration of former President Donald Trump completed.

Abbott took the interview opportunity to comment on a recent bill to impeach Homeland Security Secretary Alejandro Mayorkas by Rep. Marjorie Taylor Greene (R-GA) which failed. The governor said Mayorkas deserved to be impeached and a recent poll showed a majority of likely voters would support impeaching the embattled secretary.

Key Takeaways:

  • Texas governor plans to fight Biden all the way to the U.S. Supreme Court.
  • Legal battle over Texas’ efforts to stop illegal immigration takes center stage.
  • Abbott says Texas has a right to prevent people from entering illegally.
